You assume full responsibility for any consequences arising from not providing correct, accurate, and truthful information, or for not correcting any error before final confirmation.
Transactions made with your chosen payment method
Transactions made using your chosen payment method for Turecargas services may be carried out through: Visa, MasterCard, Diners, Discover, American Express, etc., as well as any other method available in the app. It is important that any card or payment method used for these transactions has a valid billing address and a valid issuing bank or payment service provider.
Promotions
From time to time, Turecargas or our partners, such as mobile operators, will offer promotions through the app. Each of these promotions will have its own terms and conditions, as well as an end date, which will be clearly displayed. Turecargas is not responsible for promotions offered by external operators or providers; if you have questions, you should contact them directly. Please use these promotions in good faith and do not abuse them or the promotional codes provided to you.
Fraud prevention, security and payment liability
1. Payment authorization and authentication
You expressly authorize turecargas.com to charge the payment method you have provided through our platforms when the transaction has been initiated through your user account and/or through your password, verification codes, strong authentication systems, or other identity verification processes that may be necessary to use at any given time.
turecargas.com is not obligated to implement authentication or verification measures beyond those required by applicable regulations or those that, at its sole discretion, it deems appropriate and sufficient to protect against fraud, money laundering, and other improper uses of its services, as well as to maintain the security and proper use of its platforms in accordance with its internal policies.
You are solely responsible for maintaining the confidentiality of your access credentials and for all charges and transactions made once your identity has been properly authenticated or verified, unless applicable regulations provide otherwise.
2. Fraud prevention, abuse and illicit use
Abuse and fraud in the use of our platforms are not permitted. turecargas.com actively monitors for possible situations of abuse or fraud (including, but not limited to, illegal use of payment methods, theft, fraud, embezzlement, or other illicit uses).
All purchases made through our platforms may be subject to anti-fraud verification controls. To this end, we may collaborate with specialized third-party providers in fraud prevention and risk management.
In the event of suspicion or detection of abuse, fraud, or illicit use, turecargas.com may, at its discretion and without obligation to provide justification to the user, reject a purchase order, cancel transactions, temporarily or permanently block a user account, and/or not provide the requested service, without prejudice to any legal actions that may be appropriate.
3. Additional identity and documentation verification
In situations where illicit use, identity theft, or fraud risk is suspected, or where additional security or regulatory compliance verifications are required (including, where applicable, anti-money laundering obligations), turecargas.com reserves the right to request additional documentation to confirm your identity and/or the origin of funds.
Such documentation may include, among others, a copy of a valid identification document, a bank statement, and/or other documents deemed relevant for verification.
Once the verification is completed, turecargas.com will evaluate whether or not to provide the service. The performance of these checks does not imply, in any case, an obligation to provide the service or a guarantee of acceptance of the transaction.
The processing of personal data contained in the documentation provided will be carried out in accordance with the provisions of our Privacy Policy and applicable data protection regulations.
4. Liability for service execution
turecargas.com will assume responsibility in cases of non-execution or defective execution of services purchased through our platforms when this is due to a breach attributable to turecargas.com, provided that you have acted in accordance with these Terms and Conditions, have made proper use of the platforms, and there is no falsehood, fraud, illicit use, or negligence on your part.
In such cases, and to the maximum extent permitted by applicable regulations, the liability of turecargas.com will be strictly limited to the amount of services not executed or executed defectively, and in no case may liability be derived for indirect damages, loss of profits, loss of business opportunities, or other similar concepts, unless the law provides otherwise.
5. Payment disputes, refunds and unauthorized charges
In the event of payment disputes, refunds, claims for unauthorized charges, or chargeback procedures initiated with your bank or payment method provider, the principal legal relationship regarding the charge refund will remain between you and said entity or provider, in accordance with their conditions and with applicable regulations regarding payment services.
When a charge has been properly authenticated and executed in accordance with the procedures required by applicable regulations and by our payment service providers, and there are no reasonable indications of failure attributable to turecargas.com, it will not assume additional liability for such charges beyond what is imperatively required by consumer and user regulations, payment services, or other applicable legal provisions.
All of this is understood without prejudice to the inalienable rights that correspond to you as a consumer under current legislation.
